Most divorces in New York are granted on the grounds of irretrievable breakdown of the marital relationship, but the court cannot finalize the case until all financial issues are resolved. Depending on the specific case, these issues may include the division of marital assets and debts (also known as “equitable distribution”) and spousal support (also known as “maintenance” or “alimony”) where it is requested. Where minor children are involved, separating spouses must also consider how they will support and raise their children.
To minimize unnecessary conflict, agreements are encouraged when possible.

Communication with central booking in whichever county the individual was arrested will be key to determining when that person may be released and what bail might be set. The first hearing — called an arraignment — will take place once the formal charges are determined. In New York City’s five boroughs, criminal court arraignments are held day and night, seven days a week, 365 days a year, from 8:00 AM to 1:00 AM. Mr. Roitshtein is on-call and will attend arraignment.

Mr. Roitshtein’s practice focuses on divorce, family, and criminal litigation matters. He is admitted to practice in the courts of New York.
I believe that listening to the client is paramount – it helps me understand the client’s goals, identify what to fight for, and helps me place the court’s attention squarely where it needs to be during trial.
Before opening my practice I was an associate attorney at Richardson Legal PLLC, the boutique New York City matrimonial and criminal defense firm led by Morghan Leia Richardson, Esq. While there I handled a wide array of divorce, family, and criminal matters through trial.
Upon graduating from law school I served as judicial law clerk to the Honorable Paul M. DePascale, J.S.C., Judge of the Criminal Division of the Superior Court of New Jersey in Hudson County. While there I assisted the Court in issuing decisions in a wide range of intense criminal matters.
I am a graduate of Georgetown University and the University of California, Hastings College of the Law. During law school, I won the award for academic excellence in criminal law. When not litigating, I play in recreational soccer leagues throughout New York City.
